CLEAN WATER ACT IN COURT:
GOOD MORNING I'M TYNE MORGAN IN FOR CLINTON GRIFFITHS.  A NEW TWIST IN THE WATER DEBATE. THE U-S SUPREME COURT RULING UNANIMOUSLY TUESDAY THAT CLEAN WATER ACT RESTRICTIONS CAN BE CHALLENGED IN COURT. THE SUPREME COURT RULING MAKES IT EASIER FOR LANDOWNERS TO ARGUE  THE FEDRAL GOVERNMENT'S ABILITY TO REGULATE WATER ON THEIR PROPERTY UNDER THE CLEAN WATER ACT. IT'S A RULING AGAINST THE OBAMA ADMINSTRATION AND DEALS WITH WATER POLLUTION PERMITS. IN THE CASE, THE SUPREME COURT SIDED WITH NORTH DAKOTA BASED HAWKES COMPANY, WHICH WANTS TO HARVEST PEAT FROM WETLANDS IN MINNESOTA.
RULING WILL PERMIT LANDOWNERS TO APPEAL IN COURT FOR PERMIT REQUIREMENTS:
BUT THE ARMY CORPS OF ENGINEERS STALLED THOSE PLANS, DETERMINING THE WATER LAND CONTAINED WATERS OF TEE U-S AND NEEDED TO BE FILED UNDER THE CLEAN WATER ACT. WITH TUESDAY'S RULING, A LANDOWNER CAN NOW APPEAL THROUGH THE FEDERAL COURTS OVER A WATER BODY THAT'S SUBJECT TO FEDERAL JUSRISDICTION AND PERMIT REQUIREMENTS UNDER THE CLEAN WATER ACT.
FLOODING DOWN IN TEXAS:
RELENTLESS RAINS IN TEXAS CREATED RECORD FLOODING ALONG THE BRAZOS RIVER. AND THE WORST ISN'T EVEN BEHIND THEM YET. THE RISING BRAZOS RIVER ROSE TO RECORD LEVELS, REACHING MORE THAN EIGHT FEET ABOVE FLOOD STAGE. THE BRAZOS RIVER AUTHORITY SAYS ALL 11 RESERVOIRS THAT ARE FED BY THE RIVER ARE NEARLY 100 PERCENT FULL. THE FLOODING HAS BEEN FATAL, WITH MOST OF THE FATALITIES OCCURRED IN RURAL WASHINGTON COUNTY, TEXAS.. THAT'S BETWEEN AUSTIN AND HOUSTON. THOSE RESIDENTS SAW AS MUCH AS 16 AND A HALF INCHES OF RAIN RALL IN JUST A FEW DAYS. OFFICIALS SAY THE BRAZOS RIVER WILL REMAIN AT MAJOR FLOOD STAGE FOR THE NEXT FEW EAYS. AS MORE RAIN IS ON THE WAY.
FLOODING ALONG THE MISSOURI RIVER:
FARMERS ALONG THE MISSOURI RIVER WERE ALSO ON HIGH ALERT THIS WEEKEND, AS LEVELS NEAR WAVERLY, MISSOURI REACHED THE FOURTH HIGHEST EVER. JEREMY STEPHENS SHOT THIS DRONE VIDEO. YOU CAN SEE THE WATER CREEPING INTO NEARBY FIELDS. THE ARMY CORPS OF ENGINEERS TELLS US THE WATER GOT TO THE MODERATE FLOOD STAGE CRESTING AT 29 AND A HALF FEET. BUT IT QUICLY RETRACTED DOWN TO 24 POINT 8 FEET AS OF TUESDAY. WATER IS STILL STANDING IN SOME FARM FIELDS, BUT MAJOR FLOODING IS NO LONGER A CONCERN.
CALIFORNIA DROUGHT:
THE DROUGHT PICTURE IN CALIFORNIA LOOKS MUCH DIFFERENT THAN IT DID 5 MONTHS AGO THANKS TO NEAR NORMAL RAINS AND SNOWFALL DURING THE RAINY SEASON THIS WINTER. TODAY, 21 PERCENT OF THE STATE IS UNDER THE WORST LEVEL OF DROUGHT... A 23 POINT IMPROVEMENT SINCE JUST THE START OF THE YEAR. BUT DESPITE THE STARK CHANGE, COBANK SAYS CALIFORNIA'S FARMERS AND RANCHERS COULD FACE UP TO 1 POINT 5 BILLION DOLLARS IN LOSSES THIS YEAR. THAT'S BECAUSE THE DROUGHT IS STILL GRIPPING THE STATE, INCLUDING LINGERING EFFECTS ON WATER RESTRICTIONS. THE STATE IS ALLOCATING LESS THAN 60 PERCENT OF THE STATE'S WATER SUPPLIES IN SOME AREAS. AND CO BANK SAYS THAT EQUATES TO 5 TO 7 PERCENT LOSS IN NET CASH INCOME FOR FARMERS AND RANCHERS ACROSS THE STATE. THE ISSUE IS CATCHING THE ATTENTION OF PRESIDENTIAL HOPEFUL DONALD TRUMP. AND WE'RE GONNA SOLVE YOUR WATER PROBLEM. YOU HAVE A WATER PROBLEM THAT IS SO INSANE, IT IS SO RIDICULOUS WHERE THEY'RE TAKING THE WATER AND SHOVING IT OUT TO SEA. APPLAUSE....
TRUMP SEEKS TO TACKLE WATER PROBLEM IN CALIFORNIA:
TRUMP SPEAKING AT A RALLY IN FRESNO, CALIFORNIA, SPARKING QUITE THE APPLAUSE FROM THE AUDIENCE, MANY HOLDING FARMERS FOR TRUMP SIGNS. HE ALSO TOLD SUPPORTERS HE KNOWS IT'S NOT THE DROUGHT THAT'S THE ISSUE, BUT MISMANAGEMENT OF THE WATER. ONE OF THOSE INDIVIUDALS WHO MET WITH TRUMP DURING A CLOSED DOOR MEETING LAST WEEK SPOKE TO OUR PARTNERS AT AGRITALK TUESDAY. JOHN AMARAL, WHO'S THE DEPUTY GENERAL MANAGER AT WETLANDS WATER DISTRICT SAYS TRUMP IS A BUSINESSMAN LOOKING FOR A SOLUTION TO THE PROBLEM, NOT JUST RHETORIC.
CHERRY CROP:
ACCORDING TO OUR REPORTING PARNTNERS AT THE PACKER THE CALIFORNIA CHERRY BOARD THINKS THIS YEAR'S CROP WILL BE 42 PERCENT BELOW ESTIMATES. CALIFORNIA FARMERS ARE NOW EXPECTED TO SHIP ABOUT 4 POINT 7 MILLION BOXES OF CHERRIES THIS YEAR, DOWN FROM THE 8 POINT 1 MILLION BOXES FORECASTED EARLIER. MOST OF THE CROP HAS ALREADY SHIPPED. BING CHERRIES WERE HIT HTE HARDEST, WITH MAJOR CRACKING AND OTHER PROBLEMS ALSO FROM THE PACKER, WHOLE FOODS SEEKS TO LOWER FOOD COSTS IN STORE:
WHOLE FOODS IS TRYING TO BEAT THE NEGATIVE PERCEPTION OF EXPENSIVE PRODUCE BY ROLLING AT A NEW MARKET. IT'S CALLED 365 BY WHOLE FOODS, AND THE FIRST STORE JUST OPENED LAST WEEK IN LOS ANGELES. AS YOU CAN SEE, IT LOOKS QUITE A BIT DIFFERENT, WITH MORE OF A WAREHOUSE FEEL. WHOLE FOOD SAYS IT'S TRYING TO ELIMINATE COSTS WHERE CAN IN ORDER TO OFFER LESS EXPENSEIVE PRODUCE, BUT SAYS IT'S NOT SKIMPING ON QUALITY. THE CHAIN PLANS TO OPEN TWO OTHER STORES THIS YEAR. ONE IN WASHINGTON AND THE OTHER IN OREGON WITH SEVERAL MORE STORES PLANNED FOR LOCATIONS ACROSS THE COUNTR.
CROP COMMENTS :
THE LATEST PLANTING PROGRESS RELEASED A DAY LATE THIS WEEK, AS USDA WAS CLOSED IN OBSERVANCE OF THE MEMORIAL DAY HOLIDAY. BUT THE NUMBERES SHOW THE EASTERN CORN BELT COVERED SOME GROUND. USDA SAYS AS OFMAY 31 T, 94 PERCENT OF THE CORN IS PLANTED, 2 POINTS AHEAD OF NORMAL. INDIANA, MICHIGAN AND OHIO MAKING THE BIGGEST PROGRESS, JUMPING UP MORE THAN 20 POINTS IN JUST ONE WEEK. 78 PERCENT OF THE CORN IS POPPING THROUGH THE GROUND, UP 3 FROM THE 5 -YEAR AVERAGE. PROTESTORS TOOK TO THE STREETS OF TAIPEI, TAIWAN OVER THE POSSIBLE EASING OF RESTRICTIONS AGAINST U-S PORK. THE GOVERNMENT CURRENTLY BANS U-S PORK TREATED WITH THE FOOD ADDITIVE RACTOPOMINE. BUT A NEW POLITICAL PARTY CAME INTO CONTROL TEN DAYS AGO. PROTESTORS BLOCKED THE NEW PREMIER FROM DELIVERING HIS FIRST POLICY REPORT TO THE LEGISLATIVE  COUNCIL. ACCORDING TO OUR REPORTING PARTNERS AT THE PORK NETWORK, THE NEW AG MINISTER SAYS THAT ISSUE WILL NEED TO BE RESOLVED BEFORE THE COUNTRY CAN JOIN THE TRANS-PACIFIC PARTNERSHIP. PROTESTERS CLAIM IT IS A HEALTH HAZARD. BUT THE NATIONAL PORK PRODUCERS COUNCIL SAYS THAT''S NOT A SCIENTIFIC-BASED OPINION. NEXT, YOU CAN'T BANK ON A WEATHER EVENT TO PUSH GRAIN PRICES HIGHER.
