A western New York dairy farmer faces felony charges after officials say he dumped whey from cottage cheese-making into a small creek.
Attorney General Eric Schneiderman announced Monday that 65-year-old Russell Gerow had been arraigned on charges that he violated environmental laws. Gerow was released without bail.
Gerow owns Skyline Farms in Hartsville, about 60 miles south of Rochester. Schneiderman's office says Gerow was hired by a cottage cheese maker to haul away and legally dispose of waste whey in 2013. Instead of properly disposing of the waste, investigators say he dumped it in the creek.
The Department of Environmental Conservation found high levels of ammonia and phosphorus downstream from Gerow's property.
Gerow's lawyer, Peter Skivington, called his client a hard-working farmer and said he would vigorously defend him.
