AgriTalk: Nothing Ages Quite Like Vintage…RINS?

So-called Vintage RINS (Renewable Identification Numbers) have been granted to a couple refiners. In short, the EPA is taking RINS that have since expired and put them in to the current ethanol market.

“It’s infuriating to me that [EPA Administrator Scott] Pruitt can issue 2018 RINS to some refiners in an effort to make up for waivers that weren’t issued under the previous administration.” explained AgriTalk Host Chip Flory.

Brian Jennings, CEO of the American Coalition for Ethanol (ACE) , is aware of the issue and doesn’t see how it is at all legal.

“It seems like every week there is a new wrinkle to this story,” said Jennings. “We have to get back to the rule of law, the law has to mean something.”

As it is, ACE and several other biofuels groups are taking legal action against the EPA for RFS waivers granted by Pruitt. They have already filed one suit in the 10th federal appeals circuit, specifically challenging three hardship waivers. Those three waivers include one granted to a refinery owned by  CVR Energy, which is owned by billionaire Carl Ichan.

“We’ve asked for information from EPA, and we’ve been ignored,” said Jennings. “If we win these cases, not only would we have transparency but we would also likely get to a point where the refineries would have to make up for waived volumes”

He also discusses and worked out the finer details of exemptions for drivers hauling product and livestock for the AG industry with Administrator Ray Martinez from the Federal Motor Carrier Safety Administration.
